Terms of Service

Welcome to Side Dishcounts (“Side Dishcounts,” “we,” “us,” or “our”), a hyperlocal food, drink, and events discovery platform for Colorado Springs, including our mobile application, website, and related services (collectively, the “Service”). The Service is operated by Side Dish with Schniper and Dishcount Developers (“Company”).

These Terms of Service (“Terms”) form a legally binding agreement between you and the Company. By creating an account, downloading the app, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.


1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

Some content on the Service (such as deals, offers, or business listings) may relate to alcoholic beverages. The Service does not sell or deliver alcohol, and nothing on the Service constitutes an offer to sell alcohol to anyone who is not of legal drinking age. Compliance with applicable alcohol laws is the responsibility of the participating businesses and the user redeeming any offer.

2. The Service

Side Dishcounts provides a platform for discovering local food, drink, and event businesses in the Colorado Springs area, including:

Some business and event information displayed on the Service may be sourced from publicly available data, third-party APIs, or newsletter content (such as the Side Dish with Schniper newsletter) and may not always be complete, current, or error-free. We make reasonable efforts to keep this information accurate but do not guarantee it. If you are a business owner and believe your listing is inaccurate, please contact us using the information in Section 16.

3. Accounts

To access certain features (posting Dishcos, claiming a business listing, managing offers through the admin portal), you must create an account. You agree to:

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are fraudulent, abusive, or harmful to the Service or other users.

3.1 Business Accounts

If you register a business account to manage a listing, claim offers, or post on behalf of a business, you represent that you are authorized to act on that business’s behalf. The Company reserves the right to verify business ownership and to remove or reassign listings that appear to be fraudulently claimed.

4. User Content

4.1 What Counts as User Content

User Content” means any content you submit to the Service, including Dishcos posts, photos, reviews, comments, business submissions, and profile information.

4.2 License You Grant Us

You retain ownership of your User Content. By posting User Content, you grant the Company a non-exclusive, worldwide, royalty-free, sublicensable, transferable license to host, store, reproduce, modify, display, distribute, and create derivative works of your User Content in connection with operating, promoting, and improving the Service (for example, featuring a Dishco post in the app feed or in marketing materials).

4.3 Your Responsibilities

You are solely responsible for your User Content. You represent that you own or have the necessary rights to post it, and that it does not violate any law or third party’s rights (including intellectual property and privacy rights).

4.4 Prohibited Content

You agree not to post content that:

We reserve the right, but are not obligated, to review, remove, or restrict any User Content at our sole discretion, with or without notice.

If you believe content on the Service infringes your copyright, send a notice to privacy@sidedishcounts.com including: (1) identification of the copyrighted work, (2) identification of the allegedly infringing material and its location, (3) your contact information, (4) a statement of good-faith belief that the use is unauthorized, and (5) a statement of accuracy made under penalty of perjury, signed by you or an authorized agent.

5. Business Listings, Deals, and Offers

The map and explore features rely on location data from your device. You may be prompted to grant location permissions; you can decline or revoke this permission at any time through your device settings, though doing so may limit certain features. Location and business data may not always be precise or up to date.

8. Intellectual Property

The Service, including its design, features, logos, and underlying software, is owned by the Company or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license to use the Service as intended, no rights are granted to you in our intellectual property.

“Side Dishcounts,” “Dishcos,” and related logos are trademarks of the Company. You may not use them without our prior written consent.

The Service may incorporate or link to third-party services (such as mapping data, business information APIs, payment processors, or external websites). We do not control and are not responsible for the content, accuracy, or practices of third-party services. Your use of any third-party service is subject to that party’s own terms and privacy policy.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share information. By using the Service, you consent to the practices described there.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY BUSINESS LISTING, DEAL, OR EVENT INFORMATION IS ACCURATE OR CURRENT.

YOUR USE OF ANY DEAL, OFFER, OR BUSINESS RECOMMENDATION IS AT YOUR OWN RISK. THE COMPANY DOES NOT ENDORSE ANY PARTICULAR BUSINESS LISTED ON THE SERVICE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE COMPANY’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID THE COMPANY IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless the Company from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, or your violation of these Terms.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without cause or notice, including for violation of these Terms. Sections that by their nature should survive termination (including Sections 4.2, 8, 11–13, and 15–17) will survive.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (such as an in-app notification or updated “Last Updated” date). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles.

Before filing a claim, you agree to first contact us at privacy@sidedishcounts.com to attempt to resolve the dispute informally. If we cannot resolve a dispute informally within 30 days, any claim must be brought in the state or federal courts located in El Paso County, Colorado, and you consent to the personal jurisdiction of those courts.
